Introduction

Welcome to Pizi, the mobile application ("App") developed by WiziShop, located at 8 avenue Malaussena, 06000 Nice, France ("Company", "we", "us", or "our"). Pizi is designed to transform photographs into detailed product listings with optimized names, descriptions, and SEO tags for Google. These listings can then be imported directly into your WiziShop online store. The App is intended for use by professional e-commerce merchants ("Users").

By accessing or using Pizi, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

Use of the App

User Account: To use Pizi, you must log in using an email address and connect your WiziShop account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your mobile device.
Photograph Uploads: Users can upload photographs to be transformed into product listings. By uploading a photograph, you grant us the right to use the image for creating product listings.
Intellectual Property Rights: The App, including its "look and feel" (e.g., text, graphics, images, logos), is owned by the Company and protected by intellectual property laws. You retain any rights you hold in the photographs you upload. The content generated for Users by Pizi can be used for commercial purposes on their WiziShop stores, provided they have the right to use the original photographs.
Third-Party Services: The App may use third-party services to enhance its functionality, track statistics, and improve advertising campaigns. We are not responsible for the practices of these third-party services.

User Conduct and Responsibilities

Responsible Use: You agree not to use the App to upload, post, or otherwise transmit any content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party. You are responsible for ensuring that the product listings generated are accurate and comply with all applicable laws and regulations.
Content Ownership and Rights: By uploading photographs, you warrant that you own the copyright or have obtained all necessary permissions to use and to allow us to use the photographs to generate product listings.

Legal Compliance and Limitations

Compliance with Laws: Users must ensure that their use of Pizi and any product listings generated comply with all local, national, and international laws and regulations.
Limitation of Liability: The Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the use or inability to use the services or for the cost of procurement of substitute goods and services.
Indemnification: You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of the App, including but not limited to the violation of these Terms.

Modifications and Termination

Changes to Terms: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice within the App before any new terms take effect.
Termination: We may terminate or suspend access to our App immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

Dispute Resolution

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Commercial Court of Nice, France.
